Update on the Legal Appeal

 

We submitted our brief on August 20, 2025 according to the court’s schedule. Our brief then goes to Skagit County Civil Division and they have until September 26 to respond. We then get our rebuttal of their brief due October 3.   The hearing date is October 14, 2025 in which our attorney and the County’s argue the case before the Judge, Kathy Loring.  We are not sure how long it will take for her decision.  Judge Loring is from San Juan County but the case will be heard in Skagit County Superior Court.  Interested parties can ZOOM into the hearing.  We are checking to see if we can attend in person.

 

Our concluding arguments are that the County’s actions are  “. . .arbitrary, capricious, and unlawful, imposing undue burdens on Guemes residents. Petitioners request the court invalidate R20250015, and remand for rate setting that includes all ferry revenues, properly accounts for projected O&M budgets, and eliminates unjustified increases for multi-ride discounts, hazardous materials runs and EMS services. Petitioners request the court invalidate R20250009, and confirm that the County is barred from terminating fare passes that were sold with no expiration date.”
